Se ordenó a la Sala Penal del Tribunal Superior del Distrito Judicial de Bogotá que asuma el conocimiento de la tutela de la referencia, toda vez que el conflicto planteado lo es tan sólo en apariencia, por cuanto en casos como estos, el juez de tutela que conoció a prevención de la solicitud de protección constitucional debió acudir a las reglas generales que prescribe el Art. 37 del Decreto-Ley 2591 de 1991.
